Principios del nuevo Derecho Internacional de la Pesca Maritima. Su influencia en la reforma de la Convencion de la Organizacion de Pesca del Atlantico Noroeste (NAFO

Abstract

El estudio pretende dar a conoce, de maera esquematica, el desarrollo y formacion de los elementos y criterios juridicos, medioambientales, biologicos y economicos que, desde la Concencion de Naciones Unidas sobre Derecho del Mar de 1982, han favorecido el nacimento de los instrumentos internacionales de obligado cumplimiento o de instrumentos de "soft-law" voluntarios, no vinculantes, originados por las Naciones Unidas y sus Agencias especializadas, en particular la Organizacion para la Agricultura y la Alimentacion (FAO). Asimismo, el estudio persigue destacar la influencia del nuevo derecho en la creacion de las organizaciones regionales de ordenacion pesquera (OROP) y en el reforzamiento de las existentes, con especial incidencia en la reforma de la Convencion NAFO de 1978 aprobada en Lisboa el 28 de septiembre de 2007, que la convierte en la mas moderna y desarrollada Convencion de las existentes. El estudio parte de una vision general de lso componentes del nuevo Derecho Internacional de la Pesca Maritima (Apartado III) y su aplicacion concreta a la reforma de la Concencion NAFO (Apartado IV), dando en este ultimo Apartado por supuestos los elementos y criterios descritos en el Apartado anterior. El texto definitivo de la Convencion NAFO aprobado en Lisboa, por su contenido supone mas el resultado de una negociacion ex novo que una reforma, aunque por el procedimiento seguido debe considerarse una autentica reforma de la Convencion de 1978... The paper aims to provide information, schematically, on the development and formation of the legal, environmental, biological and economic elements and criteria that, since the United Nations Convention on Law of the Sea in 1982, have favoured the birth of a new International Fishing Law in the seas and oceans around the world, arising from mandatory international instruments or voluntary, non-binding, "soft-law" instruments, stemming from the United Nations and its specialized Agencies, particularly the Food and Agriculture Organization (FAO). Similarly, the study aims to highlight the influence of the new law in the creation of the regional fisheries management organizations (RFMO) and in the reinforcement of existing ones, paying particular attention to the reform of the NAFO 1978 Convention approved in Lisbon on 28th September 2007, which makes it the most modern and developed Convention of all those in existence. The study is based on a general view of the components of the new International Sea Fisheries law (Section III) and its specific application to the reform of the NAFO Convention (Section IV), the latter section including the elements and criteria described in the former. Due to its contents, the definitive text of the NAFO Convention approved in Lisbon implied the result of an "ex novo" negotiation rather than a reform, although due to the procedure followed it must be deemed an authentic reform of the 1978 Convention.
