Urzędowe kontrole zafałszowań środków spożywczych w świetle obowiązującego prawa żywnościowego

Abstract

Formation of the common European food market, aimed at freeing flow of goods, contributed to limitation of basic, obligatory quality standards for food in Poland. Adaptation of food prices to the level affordable by Polish households is correlated with food quality. Liberalization of food standards enable producers to engage in fraudulent practices such as adulteration of food. Results of official controls show various interpretations of the definition of ‘food adulteration’ which is inherent in the Polish regulation. / Synopsis. Tworzenie wspólnotowego rynku żywnościowego i dążenie do swobodnego przepływu towarów przyczyniły się do ograniczenia obligatoryjnych wymagań w zakresie podstawowych norm jakościowych środków spożywczych w Polsce. Dostosowywanie cen żywności do możliwości nabywczych polskich gospodarstw domowych odbywa się kosztem jakości produktu. Liberalizacja przepisów w odniesieniu do podstawowych norm ułatwia producentom stosowanie nieuczciwych praktyk handlowych, polegających między innymi na fałszowaniu żywności. Wyniki kontroli urzędowych wskazują na niejednolitą interpretację zawartej w prawie krajowym definicji „środka spożywczego zafałszowanego”.
