Pour un droit des relations entre les humains et les animaux. Le cas de la production animale

Abstract

Ce travail s’inscrit dans un courant plus large de réflexions sur les relations entre humains et vivants non humains. Le modèle occidental, théorisé notamment par Philippe Descola (2005) comme un modèle naturaliste montre aujourd’hui de nombreuses limites. Pour Descola (2018), il s’agit aujourd’hui de chercher à « passer d’un monde uniforme ordonné par une division majeure entre la nature et les cultures à des mondes diversifiés dans lesquels humains et non-humains composent une multitude d’assemblages ». Dans le domaine du droit, il semble que nous partions de loin tant notre système juridique actuel apparait construit sur cette division entre nature et culture, entre humains et non-humains.
