A Technológiai Fejlődést Megalapozó Tulajdonjogi Biztonság Térbeli Jellegzetességei

A gazdasági növekedés hajtóerejének tekintett technológiai fejlődés legfőbb ösztönzője a tulajdonjogi biztonság. Számos elméleti és empirikus tanulmány alátámasztja ezen állítás helyességét, mégsem biztosított minden országban a tulajdonjogok megfelelő védelme. A technológiai fejlődéshez szükséges ösztönzők közül azért emelhető ki a tulajdonjogi biztonság, mert nélkülözhetetlen ahhoz, hogy a feltaláló az új technológiából származó hasznokat ki tudja sajátítani. Emellett a tulajdonjogok révén korlátozhatók a találmány mások általi alkalmazási lehetőségei is. Ezek alapján arra lehetne következtetni, hogy minél erősebb a védelem, annál több újdonság születik, s ily módon intenzívebb a technológiai és gazdasági fejlődés egy országban. A tanulmány a tulajdonjogi biztonság térbeli jellegzetességeinek illusztrálására törekszik azzal a céllal, hogy rávilágítson, a tulajdonjogok védelme nélkül az országok nem tudnak elindulni a gazdasági és technológiai felzárkózás útján, s ily módon a tulajdonjogi védelem területi sajátosságai a technológiai fejlettséget is jól tükrözik. ---------- Property rights protection is the most important incentive of technological progress, which is the driving force of economic growth. A number of theoretical and empirical study confirms the correctness of this statement, despite this, not all countries provide adequate protection of property rights. The property rights protection is essential to expropriation of benefits from the new technology by the inventor. This is the reason why property rights can be highlighted from incentives. In addition, property rights can be limited by the possibilities of the invention by others of application. Based on this, we can conclude that the stronger the protection, the more invention is created, and thus more intensive technological and economic development realize in a country. This paper aims to illustrate spatial characteristics of property rights protection in order to highlight its relevance. Without the protection of property rights, the country cannot start to economic and technological catch-up, and thus the territorial specificities of the property rights also reflect the level of technological development.
