A mezőgazdasági üzem fogalmának agrárjogi értelmezése

Abstract

Az agrárüzem definiálása nemcsak a közgazdaságtan, hanem az agrárjog szempontjából is számos problémát vet fel. Szakmai körökben keveredik a mezőgazdasági üzem dologösszességkénti, illetve szervezeti forma szerinti megkülönböztetése. Az uniós jog ezzel szemben a mezőgazdasági üzemet önálló jogi kategóriának tekinti és épít arra, hogy a tagországok egységes üzemszabályozási törvényben állapítják meg a nemzeti agrárüzemek működtetésének jogi-közigazgatási kereteit. Ez a feltételezés azonban csak az Európai Unió nyugat-európai tagállamaira igaz. Bár egyes üzemszabályozási elemek a magyar jogban is megtalálhatók, azok nem az agrárüzemre mint absztrakt jogi kategóriára, hanem a mezőgazdasági vállalkozások egyes konkrét szervezeti formáira vonatkoznak. Hatályos agrárjogi szabályozásunknak további sajátossága, hogy az egyes speciális agrárüzemi szervezeti formák sem egységes keretjogszabályban, hanem esetlegesen, az adott időpontban és politikai erőtérben érvényesülő jogalkotói szándék alapján jelennek meg. -------------------- Defining agricultural enterprise (farm) raises many problems not only from economic but also from a legal viewpoint. Even among professionals definitions of agricultural enterprise according to sum of objects versus organizational forms are mixed. The EU law considers agricultural enterprise as a distinct legal category and rests on the fact that member countries use a unified law to regulate frames of functioning of national farms. But strictly speaking this statement is true only for western states of the union. Although some elements of operation regulation are to be found in Hungarian law as well, they are related not to an abstract category of law but rather to concreat organizational forms of agricultural enterprises. Another feature of our agricultural law is that the different organizational forms occur not in a unified framework, rather in occasional regulations depending on jurisdiction of that time and regime.
