Abstract

This study investigates the implications of adopting the agreement on TradeRelated Aspects of Intellectual Property (Trips) on the Brazilian pharmaceutical industry as measured by its social costs and impacts on productive sector’s innovation system. We compare Brazil’s performance with China and India’s experiences. The analysis focuses on pharmaceutical productive structure in light of strengthening intellectual property rights regime on drugs supply. The literature points out very small changes on the Brazilian the pharmaceutical sector’s productive structure because of adopting the agreement; while the welfare costs were small; its industry’s technological capability remained relatively low in the postTrips, despite some improvements through the 2000s. The success of establishing intellectual property rights in the sector to foster improvement seems be related to specific characteristics of the pharmaceutical industry of each country, such as the market structure, its imitative capabilities, and how each country manages to prepare itself for the transition, as shown in China and India’s experiences.
