Abstract

-- بادئ ذي بدء أود أن أشكر لأخي الأستاذ الدكتور نزيه حماد اهتمامه بالتعقيب على بحثي المتواضع، كما أشكر له اتفاقه معي في المسألة الأساسية للبحث. أما النقاط الأخرى التي أثارها فهذا هو جوابي عنها: 1- آنية الذهب والفضة أنا لا أختار هنا رأي الإمام الشوكاني، بل أختار رأي جماهير العلماء، وأرى أن رأي أولئك القلة من العلماء إنما يقع عندي خارج دائرة الآراء المقبولة، لذلك لا أراها تجرح الإجماع الذي ذكره الإمام النووي. قال في المجموع: " أجمعت الأمة على تحريم الأكل والشرب وغيرهما من الاستعمال (كذا في الأصل) في إناء ذهب أو فضة، إلا ما حُكي عن داود، وإلا قول الشافعي في القديم" (المجموع للنووي 1/250). "حكى أصحابنا عن داود أنه قال: إنما يحرم الشرب دون الأكل والطهارة وغيرهما، وهذا الذي قاله غلط فاحش" (نفسه 1/249).
