Abstract

-- اطلعت على إجابة فضيلة الدكتور الضرير على استفسار المحرر عن رأيه في موضوع: هل يقبل شرعًا الحكم على المدين المماطل بالتعويض على الدائن؟ ومما لفت انتباهي العنوان المختار من المحرر ونصه: "الاتفاق على إلزام المدين الموسر بتعويض ضرر المماطلة". وفي اختيار هذا العنوان تجاوز صريح ينافي مفهوم الأمانة العلمية، إذ إنه يوحي بوجود اتفاق (بين الفقهاء الكرام القدامى منهم والمعاصرين بالطبع) على إلزام الموسر بتعويض ضرر المماطلة، بينما هو رأي شخصي مطروح للحوار والمناقشة. والملفت للنظر هو الفرق بين العنوان الذي صاغه المحرر الكريم بادعاء الاتفاق على إلزام المدين الموسر بتعويض ضرر المماطلة و "الموضوع" الذي كتبه فضيلة الأستاذ الضرير بيده وهو "فرض غرامات تأخير في عمليات المرابحة الشرعية التي تتجاوز فتراتها الزمنية المحددة والمتفق عليها في العقد".
