Islamic Endowments: The Need for a New Charter الأوقاف الإسلامية: الحاجة لميثاق جديد

Abstract

Based on the significant role that Waqf plays in the public life of Muslim societies, this contribution suggests the establishment of new charter in Islamic endowments (Awqaf) to enhance that role. This new building block aims to revive and preserve the effective role of the Awqaf. The paper argues that the need for such a charter that exceeds the enforcement of law and its obligation so that the perpetrators of the law cannot evade and circumvent it. Just as constitutions protect individual liberty and private property, we need a charter with constitutional power that protects Awqaf and adheres to the conditions of the waqf (the donor). تقدم هذه المساهمة لبنةً جديدةً في اقتراح بناءِ ميثاقٍ جديدٍ للأوقاف الإسلامية، وذلك بالنظر للدور الكبيـر الذي يقوم به الوقف في الحياة العامة للمسلمين. وتكمن أهمية هذا الميثاق في قوته وصرامته؛ بل يُعد في بعض جوانبه فوق قوة القانون وإلزاميته حتى لا يتمكن منفذو القانون من التهرب منه والالتفاف عليه. فكما تحمي الدساتير الحرية الفردية والملكية الخاصة نحتاج إلى ميثاق ذي قوة دستوريةٍ يحمي الأوقاف ويلتزم بشروط الواقف، وذلك راجعٌ إلى أن الوقف قد انبثق من الملكية الخاصة، والإرادة الحرة للأفراد.
