The Levied Amount of Zakāh on Camels Over 120 الزكاة الواجبة في الإبل إذا زادت عن عشرين و مائة : الترجيح والدليل على ذلك

Abstract

There are at least two opinions concerning the amount levied of zakat on camels over 120. Some scholars apply the rule “Bint laboon for each 40 camels and Hukkah for each 50 camels”. Others reapply the same rule used for numbers up to 120. Consequently, a review of these opinions seems to be important to the institution of zakat as whole and to the beneficiaries and zakat payers as well. This study intends to help in solving the conflicting views on the amount levied of zakat in this particular case, either by favoring one opinion over the other, if possible, or reconciling the two opinions. The study uses a methodology built upon the acceptable Prophetic Traditions based on evaluating and comparing these opinions with these traditions. The study concludes that the opinion held by Imam Abu Hanifah and his followers becomes the favored one after introducing some amendments into it according to the suggested opinion. تعددت الآراء حول الأنصبة والواجب فيها إذا زادت الإبل على عشرين ومائة حيث يرى البعض أن في كل أربعين بنت لبون، وفي كل خمسين حقة، بينما يرى البعض الأخر أن الواجب هو استئناف الفريضة. يأتي الاهتمام في إعادة النظر في تلك الآراء لأهميته لمؤسسة الزكاة ككل وللمنتفعين والمكلفين على حد سواء. تهدف هذه الدراسة إلى الإسهام ما أمكن في حل الخلاف الفقهي في هذه الحالة عن طريق ترجيح رأي على آخر، إن أمكن، أو التوفيق بين الآراء المذكورة والوصول إلى رأي موحد حول الموضوع. وتستخدم الدراسة لتحقيق أهدافها منهجية مبنية على ما جاء في الصحاح عن الرسول (?) حيث ترتكز على تقييم ومقارنة الآراء مع ما ورد عنه صلى الله عليه وسلم. توصلت الدراسة بعد مقارنة وتقييم الآراء ذات العلاقة وفقاً للمنهجية المستخدمة إلى أن رأي الإمام أبو حنيفة والنخعي والثوري هو الرأي المرجح بعد إدخال التعديل عليه وفقاً للرأي المقترح، مع الدليل على صحة الترجيح.
