Abstract

-- بدأ فضيلة الأستاذ بحثه بالكلام عن أهمية هذا الموضوع وهو أمر لا ريب فيه، ثم تحدث عن معالجة الفقهاء قبله لهذه المسألة، فقال: إن فقهاء المذاهب - فيما يعلم- لم يعالجوا تعويض الدائن عن تأخير الوفاء المستحق في المداينات ولم يبحثوها، وأرجع ذلك إلى ثلاثة أمور، ثم طالب الفقهاء اليوم بالنظر في هذه المسألة في ضوء مقاصد الشريعة وقواعدها العامة المستمدة من نصوص الكتاب والسنة... الخ.
