Abstract

-- نظراً لكون البحث في مجموعه يستند إلى زلات العلماء عند مخالفة النص، أحب أن أبدأ بكلام للإمام الشافعي رضي الله عنه، ذكره بعد أن نقل قضاء عمر رضي الله عنه في دية الأصابع، ثم ترك ذلك بعد أن ثبت قضاء رسول الله صلى الله عليه وسلم، بخلاف ما قضى عمر رضي الله عنه.
