Abstract

-- من قواعد الإسلام وأصوله أن الحكم يدور مع العلة وجودًا وعدمًا، وأن الحكم على الشيء فرع من تصوره. فلو كان منا نظران عند الحكم على الحلي من الذهب والفضة: نظر فيما يتعلق بالنصوص الواردة في شأن الذهب والفضة، والنهي عن بيع بعضها ببعض، دون التقابض في مجلس البيع، وبشرط انتفاء التفاضل بين العوضين، إذا كانا من جنس واحد.
