Agreement on Obliging a Solvent Debtor to Compensate for Damages of Delinquency الاتفاق على إلزام المدين الموسر بتعويض ضرر المماطلة

Abstract

It is not Islamically permissible for a bank to enter into agreement obliging a borrower to pay a fixed amount, or a certain percentage of the loan in case of delinquency in repayment. But it is valid to agree with the borrower to compensate the bank for any harm occurring to the bank as a result of the debtor's delay, provided that harm is concrete and actual, and the debtor is solvent and delinquent. The best way to determine compensation is to assess it on the basis of the actual profits earned by the bank during the period of delay. In case no profits were then earned, no compensation would be due. تبين هذه المذكرة القصيرة رأي الكاتب في أنه لا يجوز أن يتفق البنك مع العميل المدين على أن يدفع له مبلغًا محددًا أو نسبة من الدين في حالة تأخره عن الوفاء، سواء سمي هذا المبلغ تعويضًا أو غرامة أو غير ذلك، لأن هذا هو ربا الجاهلية. لكن يجوز أن يتفق البنك مع العميل المدين على أن يدفع له تعويضًا عن الضرر الذي يصيب البنك نتيجة تأخره في الوفاء، شريطة أن يكون ضرر البنك ماديًا وفعليًا وأن يكون العميل موسرًا ومماطلاً. وخير وسيلة لتقدير هذا التعويض هي أن يحسب على أساس الربح الفعلي الذي حققه البنك خلال فترة التأخر في الوفاء. وإذا لم يحقق خلالها ربحًا فلا يطالب بشيء.
