Abstract

-- المتصفح لأحكام الأجل في المعاملات المالية ولاسيما في البيع، يجد أن الشريعة أعطت للأجل قيمة. وعلى سبيل المثال: في باب المرابحة والتولية قالوا إذا اشترى إنسان سلعة بثمن مؤجل، ثم باعها مرابحة أو تولية، ولم يبين أن الثمن الذي اشترى به كان مؤجلاً ثم اطلع المشتري مرابحة على أنه كان مؤجلاً، يخير بين فسخ العقد وإمضائه على رأي الجمهور. ويحط مقدار الزيادة في الثمن للأجل عند أبي يوسف لأن الثمن المؤجل أعلى من الحال إذ هو في مقابلة المبيع والأجل فكأنه انضم إلى المبيع حال آخر. ولهذا قالوا: أن فيه شبهة الخيانة لأن للأجل شبهًا بالمال.
