Abstract

Wir untersuchen die Bedingungen, unter denen infolge der Globalisierung, insbesondere des Verfalls der (Informations-) Transaktionskosten Wettbewerbspolitik möglich ist. Zunächst zeigen wir in einem theoretischen Abschnitt die Folgen der veränderten Transaktionskosten auf institutionelle Arrangements und unterscheiden zwischen kontinuierlichem und schubhaftem Wandel. Dann werden vor diesem Hintergrund die Institute der Wettbewerbspolitik, insbesondere der Mißbrauchsaufsicht sowie der Kontrolle von Kartellen und Fusionen untersucht. Wir zeigen, daß die abstrakte Struktur des deutschen Kartellrechts hinreichend ist, daß eine vermehrte Theorieabwägung, welche wettbewerbspolitischen Bedingungen im einzelnen vorliegen, erforderlich wird, um zu wirtschaftlichen befriedigenden Ergebnissen zu kommen. Damit erhält die wettbewerbspolitische Abwägung neues Gewicht mit der Gefahr voluntaristischer Anwendungen. -- We examine the conditions under which a competition policy can be carried through in a global environment characterized by the decline of (information-) transaction costs. We first show in a theoretical section the consequences of reduced transactions costs on institutional arrangements and distinguish between continuous and discrete change. Against this background the institutes of competition policy, especially the control of market power, cartels and mergers, will be examined. We show that the abstract structure of the German anti-trust law is adequate. However, the analysis of the specific conditions must be improved from a theoretical view in order to arrive at satisfactory results. A danger remains that this leads to a voluntaristic application of anti-trust law.
