Gesundheitspolitische Steuerung zwischen Hierarchie und Verhandlung

Abstract

In der neueren Staatsdiskussion gilt die Zunahme von Verhandlungen zulasten hierarchischer Anordnung als ein Hauptmerkmal moderner Staatstätigkeit. Allerdings ist die Aufgabendelegation auf gesellschaftliche Verhandlungssysteme jeweils in sehr unterschiedlichem Maße realisiert und staatlich kontrolliert. Daher erscheint die Untersuchung von Verbindungsformen zwischen den Steuerungsmodi Hierarchie und Verhandlung notwendig. Anhand der Institutionengeschichte eines zentralen Gremiums der gemeinsamen Selbstverwaltung in der gesetzlichen Krankenversicherung - dem Bundesausschuß für Ärzte und Krankenkassen - wird hier eine vergleichsweise erfolgreiche Mischform von Hierarchie und Verhandlung analysiert. In der historischen Rekonstruktion wird die zyklische Schwankung zwischen hierarchischem Zugriff des Staates und verhandlungsförmiger Selbstregulierung durch Verbände als eine wesentliche Funktions- und Bestandsvoraussetzung des Reichs- bzw. Bundesausschusses deutlich.
