Flexibilität des M+E-Flächentarifvertrags: Ergänzungstarifverträge als Allheilmittel?

Abstract

Um Investitionen zu ermöglichen oder Arbeitsplätze in wirtschaftlich schwierigen Zeiten zu sichern, können flächentarifgebundene Unternehmen in der Metall- und Elektro-Industrie über Ergänzungstarifverträge temporär von den Regelungen des Flächentarifvertrags abweichen. Diese Abweichungspraxis wird im vorliegenden Beitrag untersucht. Eine Auswertung von knapp 400 Ergänzungstarifverträgen zeigt, dass Arbeitszeit- und Entgeltregelungen die entscheidenden Stellschrauben darstellen. So wurden in 44 Prozent der untersuchten Ergänzungstarifverträge Arbeitszeitverlängerungen vereinbart, 47 Prozent sahen Kürzungen beim monatlichen Entgelt oder bei Einmalzahlungen vor. Abweichungen in weiteren Bereichen wie bei den Altersteilzeit-Regelungen oder der Befristung von Arbeitsverhältnissen sind ebenfalls möglich, fanden sich jedoch nur in 7 Prozent der Ergänzungstarifverträge. Besteht eine Kooperationsbereitschaft zwischen Arbeitgeberseite und IG Metall, sind die Anpassungsmöglichkeiten somit breit gefächert. Im Hinblick auf kleinere Betriebe, den Verhandlungsaufwand und zu leistende Arbeitgeberzusagen sind Ergänzungstarifverträge jedoch kein nebenwirkungsfreies Instrument.
