Die Konfliktintensität von Tarifverhandlungen

Abstract

In einigen Branchen werden Tarifverhandlungen nicht nur durch Branchengewerkschaften, sondern auch durch Spartengewerkschaften geführt. Dabei kam es zu Arbeitskämpfen, die mit gravierenden negativen Drittwirkungen verbunden waren. Da dies in der amtlichen Streikstatistik nicht abgebildet wird, wurde vom Institut der deutschen Wirtschaft Köln eine neue Methode zur Messung der Konfliktintensität bei Tarifverhandlungen entwickelt. Dabei werden nicht nur materielle Konflikthandlungen wie Streik und Aussperrung, sondern auch verbalformale Maßnahmen berücksichtigt. Anhand einer Eskalationspyramide wird der Eskalationsgrad einer Tarifverhandlung statisch und dynamisch gemessen. Eine Auswertung von 123 Tarifkonflikten in Deutschland zeigt, dass Berufsgruppengewerkschaften eine hohe Konfliktbereitschaft aufweisen. Besondere Probleme entstehen, wenn mehrere konfliktfreudige Gewerkschaften bei einem Arbeitgeber in Konkurrenz treten. Dann kann es zu kumulierenden Effekten kommen, die die tarifvertragliche Friedenspflicht entwerten. Der Gesetzgeber kann dies begrenzen, indem er den Wettbewerb zwischen Gewerkschaften regelt und die Tarifeinheit wiederherstellt.
