Treatment of obstetric violence as a particular form of gender violence

Abstract

Obstetric violence is a form of gender-based violence that is poorly understood and difficult to measure, both internationally and in Cuba, due to the lack of awareness among affected women and the lack of recognition by healthcare personnel. Although the Cuban legal system protects women's equal rights and the right to freedom from gender-based violence, obstetric violence is still not explicitly recognized within its regulatory framework. To ensure effective treatment of this problem, interdisciplinary collaboration between the health sciences and law is essential, allowing for a comprehensive vision that transcends the technical analysis of medical practice and incorporates professional responsibility and a gender perspective. Preventing, eradicating, and legally addressing obstetric violence requires the active participation of women, as well as the commitment of health authorities and legislators to build a legal framework that recognizes and punishes this form of violence.
