Die kommunalen Finanzausgleichssysteme in der Bundesrepublik Deutschland: Die Bestimmung des Finanzbedarfs

Abstract

Bei der Bestimmung des Finanzbedarfs handelt es sich um ein zentrales, in vieler Hinsicht problembehaftetes Element des kommunalen Finanzausgleichs. Statt des Bezugs auf die originären Aufgaben der Kommunen stellen die derzeitigen Regelungen auf Gemeindeeinwohner ab und nehmen dabei eine Gewichtung mit wachsender Gemeindegröße vor. Während sich die Anwendung derartiger Hauptansatzstaffeln hauptsächlich auf die zweifellos gegebenen Praktikabilitätsvorteile stützt und die umfangreiche Verfahrenskritik weitgehend ausblendet, haben den Wechsel zur vermutlich besseren Alternative, dem Zentrale-Orte-Ansatz, erst drei Bundesländer vollzogen. Ergänzende zentralitätsbezogene Instrumente sind gleichwohl in allen Finanzausgleichssystemen zu finden. Die Berücksichtigung weiterer Sonderbedarfe sollte in Form von (möglichst wenigen) Ergänzungsansätzen oder besser noch mittels finanzkraftunabhängiger Instrumente außerhalb des Schlüsselzuweisungssystems erfolgen.
