Italian abstract: In questo saggio intendo rileggere, disarticolare e problematizzare il dibattito Einaudi-Croce sul rapporto tra liberismo e liberalismo muovendo da una prospettiva epistemologica lato sensu costruttivista, volta a mostrare l’insufficienza esplicativa della dicotomia ‘empirismo vs idealismo’ quale chiave di lettura delle loro reciproche incomprensioni. Pur muovendo da problemi diversi, l’idealismo e l’empirismo (e poi l’empirismo logico) sono accomunati dalla credenza di aver risolto il problema dell’ideale e della normatività cancellandolo – il primo identificando reale e razionale, il secondo espungendo dall’ambito del conoscere e del teoretico i giudizi di valore – o relegandolo all’ambito del pratico. Ciò nonostante, è sintomatico che tanto Croce quanto Einaudi si troveranno ad invocare, attraverso la nozione di Weltanschauung, l’‘incarnazione della legge’, testimoniando così l’insopprimibile idealità del loro discorso, compreso quello sulle leggi economiche o sulle leggi giuridiche. Muovendo dalla nozione di figura (Di Robilant) e di finzione (Borutti) (§ 1), intendo mostrare che il problema della normatività della legge è inerente all’ambito del conoscere (§ 2), e che ha a che fare con le varie forme di mediazione (tra io e mondo, sé ed immagine di sé, ecc.) che tanto l’empirismo quanto l’idealismo non riescono ad espungere (§ 3). English Abstract: In this essay I intend to re-read, disjoint and problematize the Einaudi-Croce debate on the relationship between liberalism and liberalism, moving from a ‘lato sensu’ constructivist epistemological perspective, showing how and why the dichotomy 'empiricism versus idealism' is misleading and insufficient to explain their mutual misunderstandings. Despite moving from different problems, idealism and empiricism (and then the logical empiricism) are united by the belief to have solved the problem of ideal and normativity by simply deleting them – the idealism by identifying real and rational, the empiricism by chasing away value judgments from the field of knowledge and that of theory – or by relegating them to the sphere of the practical. Nevertheless, it is significant that both Croce and Einaudi invoke, through the notion of Weltanschauung, the ‘incarnation of the law’, thereby demonstrating the irrepressible ideals of their discourse, such as those on economic laws or legal norms. Building on the concept of 'figure' (Di Robilant) and 'fiction' (Borutti) (§ 1), I intend to show that the problem of the normativity of law is inherent to the field of knowledge (§ 2), and that it has to do with the various forms of mediation (between the self and the world, self and self-image, etc.) that both empiricism and idealism cannot expunge (§ 3).
