Abstract

Les USA utilisent le droit américain comme une arme économique. Les lois américaines sont certes agressives à l'encontre des pays jugés voyous et de la corruption, mais elles s'appliquent de plus en plus dans l'ensemble du monde économique et financier, grâce aux formes d'extraterritorialité de son droit. Les entreprises et les banques européennes ont dû s'acquitter de lourdes amendes pour continuer à être des acteurs sur le marché américain. De nombreuses lois s'imposent, au moins indirectement, aux entreprises étrangères, notamment « Helms-Burton », « d'Amato-Kennedy, « Foreign Corrupt Practises Act (FCPA) », Bank Secret Act, Racketeer Influenced Organization, Foreign Immunities Act ou l'US Export Enhancement Act ou les principes US Person ou non-US Person. L'effet extraterritorial des sanctions économiques constitue un défi à l'indépendance politique et stratégique des autres pays, notamment lorsque les faits ne sont punis par aucune organisation internationale (FMI, ONU, etc.). Le leadership juridique, politique, stratégique et économique des Etats-Unis sur l'ensemble des Etats et des entreprises dans le monde n'est pas « bienveillant » ou « équitable », il est directif, à la fois juge et partie.
