Оценка Качества Работы Судей В Контексте Антимонопольного Регулирования

Abstract

Для России как для страны с переходным этапом институционального развития вопрос оценки качества института судебного контроля норм государственной политики особенно актуален. В статье анализируются параметры качества судебных решений на примере антимонопольных дел с позиций международной практики и российской специфики. На основании уникальной базы данных арбитражных дел в отношении решений о нарушении антимонопольного законодательства проведен анализ основных закономерностей, определяющих степень качества выносимых решений со стороны судей. Параметр качества решений обусловлен минимизацией ошибок правоприменения и определяется такими индикаторами, как факт апелляции; соответствие решений судов первой и вышестоящих инстанций; а также совокупное число инстанций, рассматривающих дело, как индикатор качества рассмотрения дела во всей судебной системе. Среди факторов, оказывающих влияние на качество, особое внимание уделено следующим параметрам: индивидуальные характеристики судей, комплексность требуемого подхода к анализу потенциального нарушения и оспариваемые санкции. Показано, что специализированный опыт судьи в рассмотрении дел определенного типа оказывает наиболее интенсивное влияние на принятие решения, которое не будет впоследствии отменено судами вышестоящих инстанций.
