Common property rights e traditional knowledge: appunti comparatistici in tema di diritti di propriet? intellettuale delle collettivit? locali

Abstract

L?espressione traditional knowledge fa riferimento all?insieme di conoscenze, pratiche, innovazioni, forme di arte e di spiritualit?, nonch? altre forme di espe-rienza culturale e di espressione, che appartengono alle comunit? indigene di tutto il mondo. L?obiettivo del saggio ? quello di analizzare il rapporto sussistente tra la traditional knowledge e la propriet? intellettuale verificando, in particolare, se questi "saperi tradizionali" possano costituire oggetto di propriet? intellettuale e se quest?ultima, di conseguenza, possa "spettare" alla collettivit? locale detentrice di tale conoscenza. Dopo aver delineato i concetti di biopiracy e di bioprospecting, l?analisi si concentrer? sulla normativa internazionale in materia di propriet? intel-lettuale, al fine di verificare se tale disciplina possa essere utilizzata per tutelare le conoscenze tradizionali delle popolazioni locali. Inoltre, nel coso dell?indagine ver-ranno analizzate le teorie che considerano la conoscenza tradizionale in termini di propriet? culturale. Infine, dopo aver offerto una panoramica dei principali inter-venti giuridici posti in essere da alcuni Stati per difendere le conoscenze detenute dalle collettivit? locali, si analizzeranno le numerose proposte volte a proteggere la conoscenza in questione.
