Menschenrechte und richterliche Unabhängigkeit in den Ländern des Donauraumes

Abstract

Richterliche Unabhängigkeit und Unparteilichkeit sind Garanten für die in nationalen Verfassungen und in internationalen Verträgen festgelegten Menschenrechte. Die Durchsicht der einschlägigen Vorschriften der Verfassungen und der Gesetze zeigt zwar, dass auf legislativer Ebene die richterliche Unabhängigkeit in den Ländern des Donauraumes gesichert ist. Die Verfassungsgerichte und der Europäische Gerichtshof für Menschenrechte haben bedeutend zum Schutz der richterlichen Unabhängigkeit gegen Eingriffe der Exekutive und zur Stärkung der richterlichen Unabhängigkeit und Unparteilichkeit dort beigetragen. Obwohl sogar in etablierten Rechtsstaaten das absolute Verbot von Folter und unmenschlicher bzw. erniedrigender Behandlung manchmal verletzt wird, sind jedoch systematische und sich wiederholende Menschenrechtsverletzungen wegen struktureller Defizite typisch für die neuen Demokratien Europas.
