Abstract

Restricciones Verticales, Residual Claimant y Predación Vertical: Algunas Consideraciones sobre la Distribución de Cerveza en Venezuela Resumen: Si bien la literatura de competencia y economía industrial reconoce las posibles eficiencias que puedan generarse de contratos de distribución exclusiva, también se reconoce que de este tipo de organización Inter.- empresarial se desprende un poder de mercado por dependencia económica. Asimismo, es un hecho común o notorio encontrar la imposición de más de un tipo de restricción vertical en una misma relación comercial u organización Inter.-empresarial del tipo vertical. Si bien en la Ley para Promover y Proteger el Ejercicio de la Libre Competencia de Venezuela y en la doctrina del ente encargado de administrarla, la Superintendencia para la Promoción y Protección de la Libre Competencia, no se castiga ni prohíbe la posición de dominio, deberá velarse porque las posiciones de dominio que se desprenden de este tipo de organización Inter.-empresarial no tiendan a determinar prácticas abusivas o anti- competitivas. Este trabajo expone estas consideraciones en el mercado de distribución de cerveza en Venezuela.
