Abstract

Резюме: С разпореждане от 29 юли 2021 г. на председателя на Върховния административен съд (ВАС) е образувано тълкувателно дело за приемане на тълкувателно решение от Общото събрание на съдиите от колегиите на ВАС по следния въпрос: Допустим ли е иск по чл. 1, ал. 1 от ЗОДОВ за обезщетение за неимуществени вреди от отменена като незаконосъобразна заповед за прекратяване на служебно правоотношение по ЗДСл., ЗМВР, ЗДАНС, ЗОВСРБ и др. специални закони, предвиждащи право на обезщетение в размер на получаваните възнаграждения? В настоящото становище се предлага отговор на поставения тълкувателен въпрос, въз основа на позитивно-правни и логически аргументи. Предлаганият отговор е, че такъв иск е недопустим.
