Abstract

Предмет на настоящото научно изследване са две хипотези на допустимо едностранно предоставяне от работодателя на неплатен отпуск без съгласието на работника или служителя. Направено е сравнение между двете хипотези, като едната вече не е действащо право, а другата е такава. За целта се обсъжда накратко и правната същност и социално-правното предназначение на неплатения отпуск по чл. 160, ал. 1 от Кодекса на труда, за да се открои разликата между него и хипотезата на едностранно предоставяне от работодателя на неплатен отпуск. Предложена е видова класификация на неплатените отпуски по действащото българско трудово право. Under consideration in the present scientific research are two hypothesis of possible unilateral unpaid leave granted by the employer without the consent of the worker or the employee. A comparison is made between the two hypothesis bearing in mind that the one is not currently in force while the second is still applicable. To this aim under brief analysis are the legal nature and the social and legal designation of the unpaid leave under article 160 (1) of the Bulgarian Labour Code in order to differentiate between this type of leave and the hypothesis of unilateral unpaid leave granted by the employer. The author offers a classification by type of the forms of unpaid leave under the current Bulgarian Labour Law.
