Abstract

The subject of the scientific study in the paper is the comparative analysis between the current positive legal regulation of the so-called „labour relationship which has not come into being“in the Bulgarian and the Russian labour law. A comparison is made between the legislative regulation of this issue in the second sentence of Article 63 (3), Article 86 (7) and the first sentence of Article 96 (4) of the Bulgarian Labour Code and Article 61 (4) of the Labour Code of the Russian federation. In the current Russian labour law this legal institute is known as „annulment of the labour contract“, which is a right of the employer. In Bulgarian labour law the problem with the labour relationships that have not come into being is resolved legally and technically by means of the use of a legal fiction. Предмет на научното изследване е сравнителноправният анализ между действащата позитивно-правна уредба на т.нар. „невъзникнало трудово правоотношение” в българското и руското трудово право. Направено е сравнение между законодателното уреждане на този проблем в чл. 63, ал. 3, изр. второ, чл. 86, ал. 7 и чл. 96, ал. 4, изр. първо от българския Кодекс на труда и чл. 61, ал. 4 от Трудовия кодекс на Руската федерация. В действащото руско трудово право този правен институт е известен като „анулиране на трудовия договор”, право на което има работодателят. В българското трудово право проблемът за невъзникналото трудово правоотношение е разрешен правно-технически чрез използването на правна фикция.
