Abstract

Une partie des réformes du droit du travail initiées il y a une dizaine d'années a porté plus précisément sur le droit du licenciement, avec pour objectif principal d'assouplir les règles encadrant ces procédures juridiques et de baisser in fine le coût de séparation pour l'employeur. Il s'agit dans ce chapitre de revenir dans une première partie sur les arguments économiques utilisés pour justifier ces réformes, et dans une seconde partie de présenter un cadrage statistique sur l'usage des licenciements dans les établissements français, à partir des données sur les mouvements de main-d'œuvre de la Dares. À l'aune de ces éléments, la conclusion éclairera les possibles conséquences que l'on peut attendre des dernières réformes (loi El Khomri 2016 et Ordonnances 2017) sur le recours au licenciement par les employeurs et sur les mobilités des salariés sur le marché du travail.
