El nuevo constitucionalismo latinoamericano: promesas e interrogantes

Abstract

En este escrito se seleccionan y estudian críticamente algunos de los rasgos distintivos del constitucionalismo regional. Entre otros, se examinan la organización de los poderes y la estructura de los frenos y contrapesos", la definición, alcance y viabilidad de los derechos incorporados, las relaciones entre las partes orgánica y dogmática de la Constitución, las posibilidades y los límites del reformismo constitucional. El estudio de las actuales tendencias en materia constitucional es realizado a la luz del constitucionalismo originario, enraizado en el siglo XIX."
