Ungelöste Probleme der Bankenaufsicht

Abstract

Die vorliegende Analyse thematisiert die Bankenkrise bzw. die Krise der Finanzmarktaufsicht in Deutschland in 2007. Im Anschluss an eine Skizzierung der Hauptprobleme werden zahlreiche Schlussfolgerungen vorgestellt, die auf eine nationale und internationale Reform der Finanzmarktaufsicht hinauslaufen. Die Bankenaufsicht in Deutschland ist dringend reformbedürftig, wobei die Rolle der Deutschen Bundesbank zu stärken ist. Unabdingbar ist insgesamt Druck zugunsten einer Stärkung der Qualität des Risikofrühwarnsystems der Banken, wobei sich hier bei einer Minderheit von Banken in Deutschland - häufig gerade auch Landesbanken - und einigen anderen EU-Ländern seit den 90er Jahre negative Entwicklungen verfestigt haben. Im globalen Währungswettbewerb wird der Euro nur dann eine langfristige Chance gegen den US-Dollar haben, wenn die Qualität der Bankenaufsicht deutlich verbessert wird. Auch die Grundlagen für ein Krisenmanagement in der Eurozone sind zu verbessern, da hier unklare Zuständigkeiten und keine klaren Verantwortlichkeiten bestehen. Missstände bei den Bilanzierungsstandards in den OECD-Ländern sind dringlich abzubauen. Der Fall IKB Deutsche Industriekreditbank zeigt mit Blick auf die Rhineland Funding Capital Corporation, dass der Bank die Risiken dieser Konstruktion unklar waren bzw. Anleger in die Irre geführt wurden - zudem ist offensichtlich über eine Meldepflicht bei Mega-Kreditlinien nachzudenken
