La Autonomia Reforzada: Una Solución Pragmática Al Colonialismo Estructural En Colombia

Abstract

Sobre la base del trasfondo teórico que ofrecen los postcolonial studies, en este trabajo se parte de un análisis antropológico de la realidad social latinoamericana y del estudio de las normas y la jurisprudencia relevantes para las comunidades indígenas en Colombia, con el objetivo de establecer si las relaciones que existen entre Occidente y tales grupos humanos son o no igualitarias. Tras constatar la desigualdad que condiciona las relaciones entre ambas culturas, se propone la implementación de un nuevo modelo territorial que sea capaz de producir en mayor medida condiciones de igualdad: esta solución consiste en la atribución de una forma reforzada de autonomía territorial en cabeza de las comunidades, concebida como un instrumento jurídico adecuado y eficaz para materializar los ingredientes democráticos y pluralistas contenidos en la Constitución de 1991.
