Abstract

Retos Jurídicos para la consulta previa a partir del análisis de su operación en el sector minero es un libro que permitirá al lector acercarse a las dificultades de la "operacionalización" de este mecanismo de participación ciudadana. Este trabajo de investigación tuvo como objetivo principal identificar los retos jurídicos que plantea el ejercicio de este derecho principalmente en el sector minero.Para lograr dicha identificación fue necesario desvelar la distorsión en la que actualmente se encuentra sumergida la consulta previa en general; luego, hacer una descripción de la operación sectorial de este derecho en las actividades relacionadas con los hidrocarburos, energía y minería, por regiones y grupos étnicos; por último, entrar de lleno en los retos jurídicos a los que se enfrenta la consulta previa en el sector minero.El resultado de la investigación aquí documentada servirá de insumo para las decisiones de los agentes del sector público-privado, así como que la toma de políticas públicas y las decisiones del operador jurídico estén mejor informadas. El desafío está en encontrar la solución a los retos planteados de lo cual depende en parte el alcance de la licencia social de las actividades mineras en las comunidades con derecho a la consulta previa.
