Sobre la teoría de la pena

Abstract

Crítica a la teoría de la unión y sus variantes, pues según Jakobs las teorías de la pena orientadas a la retribución y a la prevención no pueden unirse en una teoría ya que la retribución de culpabilidad deslegitima la prevención y no aporta una teoría de la pena pública. Finalmente el autor ve la pena como una contribución al mantenimiento de la realidad social y que por tanto debe ser ejecutada.
