Die Einfuhr eines Zebrafells im Reiseverkehr – Prüfungen im Artenschutzrecht (Teil 2)

Abstract

Im grenzüberschreitenden Warenverkehr (v. a. Reiseverkehr o. Postverkehr, aber auch Übersiedlungsgut) werden häufig Exemplare von Tieren oder Pflanzen eingeführt, deren Einfuhr dem Washingtoner Artenschutzübereinkommen CITES (Convention on the International Trade in Endangered Species of Wild Fauna and Flora) und damit der EU-Artenschutzverordnung (EG) Nr. 338/97 und dem Bundesnaturschutzgesetz (BNatSchG) entgegenstehen könnte. „Elefanten sind geschützt, das weiß doch jeder“, sagte mir kürzlich eine leitende Fachkraft aus dem Sachgebiet Kontrollen, die federführend für den Reiseverkehr am Flughafen zuständig ist. Naja, wenn das immer so eindeutig und einfach wäre ... Die allgemeine Antwort ist: Ja, Affen, Elefanten, Wale, Haie und Zebras sind vom CITES geschützt, aber nicht alle. Und die Unterscheidung macht es in der Praxis schwierig, zeitnah und unter Druck festzustellen, ob es sich tatsächlich um ein geschütztes Exemplar i. S. d. Artenschutzrechts handelt. Dieser Beitrag liefert am Beispiel eines Zebrafells (das so tatsächlich eingeführt worden ist) Probleme und Lösungsmöglichkeiten mit Anwendung neuer und alter Techniken.
