Projects Of Harmonization Of The Laws On Insolvency

Abstract

Ample legislative projects are in progress, both at a European level and at an international level, in order to harmonize the insolvency regulations. Undoubtedly, at the present time the implementation of a unitary insolvency law applicable at a global level cannot be brought into discussion because of the significant differences existing among the national legal systems. The project initiated at the level of the European Union sets out to identify the aspects that may be harmonized in the matter of insolvency at a European level while the Project of the Global Principles in Insolvency is trying to lay down the principles that may apply in case of a crossborder insolvency procedure.
