Критерии (Условия) Передачи Государственных Полномочий Организациям: Опыт Зарубежных Стран

Abstract

Предметом статьи являются критерии и условия передачи государственных полномочий организациям. Цель исследования состоит в выявлении оптимальных и эффективных подходов к установлению и применению критериев и условий при передаче государственных полномочий организациям. К исследовательским задачам в настоящей работе относятся: 1) изучение российского опыта и позиций отечественных ученых в данном вопросе, 2) опыта США, где наиболее полно и подробно раскрыта поднимаемая в статье проблема, и 3) анализ опыта таких европейских стран, как Франция и Германия, а также Европейского Союза. В работе использован метод анализа позиций ученых и главным образом судебной практики зарубежных судов, в которых рассматриваются и анализируются критерии и условия передачи государственных полномочий организациям. Исследование показало отсутствие в российском праве детального правового регулирования критериев и условий передачи государственных полномочий организациям. Анализ зарубежной судебной практики привел автора к выводу, что наиболее эффективный подход в вопросе применения критериев и условий передачи государственных полномочий организациям - это многофакторный анализ наподобие выработанного Верховным судом штата Техас, который одновременно вбирает в себя сразу несколько самостоятельных критериев, что делает их более конкретными и снижает простор для различных интерпретаций передачи полномочий.
