Verseny a közbeszerzési piacon

Abstract

A közbeszerzés erősen szabályozott környezetének kutatása megkívánja, hogy ne pusztán jogi elemzések, szabályértelmezések szülessenek, hanem megismerhessük a közbeszerzési piac érintettjeit, a piac sajátosságait, nehézségeit, a verseny támo gatásának mesterséges korlátait is. A cikk azon a kutatáson alapul, amely kérdőíves felmérésekkel és mélyinterjúkkal vizsgálta a közbeszerzési piac jellemzőit, a verseny korlátozó elemeket, a szereplők vélekedését a verseny és közbeszerzés kapcsolatá ról, érintve az intézményrendszeri környezet hiányosságait is. Gyakorlati példákkal világít rá azokra a hibákra, a beszerzési kérdéseket háttérbe szorító jogi megközelítés problémáira, amelyek a verseny érvényesülését gátolják.
