Perequazione urbanistica "estesa", rendita e finanziarizzazione immobiliare: un conflitto con l?equit? e la qualit? territoriale

Abstract

Il nuovo istituto della perequazione "estesa" - cio? utilizzabile in qualunque luogo della citt?, qualechessia il luogo in cui ha trovato origine - presenta una intrinseca contraddizione: esso costituisce un passo in direzione della finanziarizzazione del settore immobiliare, e per questo tende a trattare come equivalenti e fungibili diritti che equivalenti non sono, essendo di natura "immobiliare" e cio? legati ad ambiti specifici. Ne seguono vantaggi indebiti per la rendita di trasformazione, e dunque limiti di equit?, oltre ai limiti connessi con la perdita di controllo dei processi di trasformazione urbana. Le modalit? con cui ? stato introdotto nel piano di Milano limitano alcuni rischi estremi, ma presentano tutte le contraddizioni indicate che ne condizioneranno l?operativit?.
