L?agricoltura sociale: profili giuridici

Abstract

L?agricoltura sociale include un vasto range di attivit? e cos? non ? facile definirla. Ma nell?ampia serie di questioni che interessano, notiamo sempre due elementi in comune: a) si tratta di attivit? che si svolgono in un?azienda agricola; e b) sono prospettate per soggetti che - temporaneamente o in modo permanente - presentano delle specifiche necessit?, incluse necessit? educative. La legge italiana 18 agosto 2015, n. 141 (?Disposizioni in materia di agricoltura sociale?), "promuove l?agricoltura sociale quale aspetto della multifunzionalit? delle imprese agricole" (art. 1, ?Finalit??). Nel corso del tempo, l?agricoltura sociale si ? presentata sotto molteplici forme, impiegando risorse agricole e confluendo indistintamente sotto la medesima etichetta "agricoltura sociale", tuttavia essendo caratterizzata da approcci, relazioni intersettoriali, finanziamenti molto diversi tra loro. A questo proposito, si pensi solo alle esperienze di c.d. farming for health (agricoltura per la salute), care farming, green care o green therapies (terapie verdi) riferibili alle cure, al reinserimento, alla riabilitazione o altro. Occorre quindi ricondurre ad una cornice giuridica di riferimento un settore di disciplina che riguarda un ampio spettro di attivit?, anche al fine di accompagnarne lo sviluppo in un percorso organico e coordinato sul piano istituzionale (a livello europeo e nazionale).
