Il World Class Manufacturing nello specchio del diritto del lavoro

Abstract

L'articolo analizza l'impatto del "World Class Manufacturing" sul diritto del lavoro. I temi presi in considerazione sono sia gli istituti del rapporto individuale che quelli delle relazioni collettive di lavoro. Sul piano del rapporto individuale di lavoro, l'impatto più significativo prodotto dal WCM sul diritto del lavoro appare quello che si genera sul concetto di subordinazione, in relazione al ruolo che il lavoratore assume nella progettazione del lavoro, nonché all'importanza che nella nuova organizzazione assume il lavoro di squadra. Sul piano delle relazioni collettive assume rilievo una nuova forma di partecipazione, legata alla condivisione di conoscenze ed esperienze progettuali, ma slegata dalle tradizionali strutture della partecipazione sindacale. In conclusione, l'articolo si interroga sull'adeguatezza del diritto del lavoro moderno a rispondere alle sfide imposte dai nuovi modelli di organizzazione del lavoro.
