Les exceptions à l’immunité d’exécution souveraine au Canada et le droit international : mimétisme, progressisme ou illicéité ?

This article traces the evolution of immunity from execution against foreign states in Canada through the development of exceptions to immunity. Initially an advocate of the doctrine of absolute immunity, Canada has now evolved to the point where certain exceptions – such as that relating to terrorism – are now being questioned even before the International Court of Justice. The consistency of Canadian practice with the country’s progressive values is also called into question by the absence of any consideration of jus cogens.
