Le passage de la soft law à la hard law pour la gestion et la régulation internationale des pesticides : une étape nécessaire ou inutile ?

Abstract

Having noted the need to achieve common standards for the regulation of international trade in pesticides, the members of the FAO, at the 23rd session of its General Assembly in 1985, sought to equip themselves with a new instrument framing the behaviour of States in this area. Despite numerous periodic revisions, the Code still cannot be characterised as an ambitious and comprehensive legal regulation. The objective of this work is to examine whether these standards might gain authority and scope through a legally binding regulation (hard law) at the international level replacing the current soft law regulation contained in the 1985 Code.
