La régulation des fake news et avis factices sur les plateformes

Abstract

This contribution examines whether and how to regulate the circulation of ?fake news? and ?fake reviews? on digital platforms. Those two types of information disorder affecting the platforms of social networks and the collaborative economy, respectively, result from the new forms of online expression. Any attempt to regulate them requires carefully defining the most abusive and misleading practices that deserve to be taken into consideration and regulated. This contribution examines the initiatives or legislations adopted by the European Union and Member States (Belgium, France, Germany, the United Kingdom) to cope with information disorders. The promotion of transparency, in particular regarding the sources of funding for advertising campaigns or online reviews, can partly address the information disorder problems. This contribution in particular favors some changes to the platforms? architecture in order to increase the costs of spreading poor-quality information.
