La démocratisation de la procédure de règlement des différends de l’OMC : une vraie ouverture pour les acteurs privés ?

Abstract

The democratization of the WTO dispute settlement procedure already marks an important transformation of this system. The acceptance of amicus curiae briefs and the opening of public hearings by panels and the Appellate Body are two remarkable figures. However, it is clear that this transformation is only halfway. The practical and legal limitations still prevent an official codification of such opening to the benefit of private actors? access to the system. It allows critics of the democratic deficit which this system was facing from its creation to be widespread.
