Systém riešenia sporov vo WTO

Abstract

Riešenie sporov v rámci GATT (1947) sa sústredilo na používanie panelov pozostávajúcich z troch alebo piatich jednotlivcov. Hoci išlo o dosť úspešný systém, rozhodnutia boli prijímané konsenzom všetkých zmluvných členov GATT, do ktorého boli zahrnuté aj sporové strany, ktoré mohli zdržať alebo dokonca zablokovať rozhodovací proces. Toto viedlo niektoré strany k prijímaniu jednostranných opatrení. Systém riešenia sporov v rámci WTO obsahuje dve základné zmeny, a to ustanovenia o odvolacom konaní, v rámci ktorého Odvolací orgán má možnosť preskúmať rozhodnutie poroty, a ustanovenia o odškodnení alebo protiopatreniach.
