Princípy európskeho zmluvného práva - história ich vzniku, štatút, vybrané ustanovenia

Abstract

Práce nad prípravou Princípov Európskeho zmluvného práva začala Komisia pre európske zmluvné právo v roku 1982. Časť I Princípov bola publikovaná vo Veľkej Británii v roku 1995. Druhé vydanie Princípov európskeho zmluvného práva obsahujúce Časť I a II bolo publikované v roku 1999. S prácami na tretej časti Princípov začala Komisia v roku 1997 v Regensburgu. Aktuálne znenie Princípov bolo po prvýkrát publikované na Slovensku v roku 2010 a obsahuje sedemnásť kapitol. Cieľom tohto článku je charakteristika histórie vzniku, podstaty a vybraných ustanovení Princípov a vyzdvihnutie ich významu pre aproximáciu súkromného práva členských štátov EÚ. Príspevok je publikovaný v rámci projektu VEGA č. 1/0696/10: Vybrané aspekty práva medzinárodných ekonomických vzťahov.
