Sekundárne pramene európskeho práva

Abstract

Sekundárnymi prameňmi európskeho práva sú jednostranné legislatívne akty orgánov Spoločenstiev, ktorých platnosť je odvodená od pôvodných konštitučných zmlúv. V právnej hierarchii sú zaraďované až za primárne pramene, ich platnosť a rozsah musí byť v súlade s kritériami uvedenými Zmluvami. Dôležitosť zákonodarnej právomoci Spoločenstiev musí byť neustále zdôrazňovaná, nakoľko najdôležitejším prostriedkom, ktorým supranacionálna organizácia dosahuje svoje ciele je práve zákonodarná moc 270. Zakladajúce zmluvy sa pritom obozretne vyhýbajú pojmu legislatíva a používajú termíny ako smernice, nariadenia a pod., aby sa pri zakladaní Spoločenstiev vyhli nevôli národných parlamentov nad preberaním ich právomocí. Bez ohľadu na rôznosť názvov právne akty Spoločenstiev disponujú všetkými charakteristikami riadnej legislatívy.
